The short version. You must be 18 or older to play: Heist Fall is a game for adults, with violence and fictional criminal businesses, including drug production. Dead Coin and in-game items are for fun and have no cash value. Don't cheat, don't use bots and be decent to other players. Purchases are final unless the law says otherwise. If you break these rules we can suspend or close your account. The full terms below are what count.
1. Agreeing to these terms
These Terms of Service ("Terms") are a legally binding agreement between you and [LEGAL ENTITY NAME], LLC, a limited liability company organized under the laws of [STATE] ("Undead Island", "we", "us", "our"). They cover the Heist Fall game, this website and any related services (together, the "Game").
By creating an account or playing, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don't agree, please don't play.
2. Who can play
The Game is for adults: you must be at least 18 years old, or the age of majority where you live if that is higher, to create an account or play. By creating an account or playing, you confirm that you meet this age requirement and that you are legally able to agree to these Terms.
New accounts confirm their age when they sign up (birth month and year, plus a box confirming you are 18 or older). If the answer is under 18, sign-up is refused and the device can't try again with a different date. We keep only the fact that the check was passed, never the date itself.
If we learn that an account belongs to someone under 18, we will close it and delete its data, as explained in the Privacy Policy. Accounts created before [EFFECTIVE DATE OF 18+ RULE], when the minimum age was 13, are covered by these Terms from that date.
You can't use the Game if we have banned you before, or if the law where you live doesn't allow it.
3. Mature themes
Heist Fall contains mature content and is intended for adults. The Game includes, among other things:
- Fictional criminal businesses. Players run a criminal Hideout with facilities named after real illegal drugs and drug production (for example a Grow Yard, a Meth Lab, Coca Works and a Pharmacy), sell "contraband", smuggle goods, steal, break into vaults and work for fictional cartels.
- Violence. Cartoon-style vehicle combat with guns, explosives and fire against zombies, AI drivers and other players.
- Online interaction. Chat, usernames and market listings written by other players, which we don't check before they appear.
All of this is fiction and stylized game mechanics. Nothing in the Game shows how to make, obtain or use real drugs or weapons, and nothing in it encourages or endorses illegal activity, drug use or violence in real life. Don't play if you don't want to see this kind of content.
4. Your account
- You sign up with a username and password, using a one-time invite key while the Game is in beta. Keep your password to yourself. You're responsible for everything that happens on your account.
- One person per account. Don't share, sell, buy, rent or give away accounts.
- Your username must follow the Community Guidelines. We can change or reclaim a username that breaks them.
- Tell us right away at support@undeadisland.gg if you think someone else has got into your account.
5. The beta
The Game is in an invite-only beta. That means things will change: we add, rebalance and remove features, cars, items and prices. Some changes may affect your progress, and during the beta we may need to adjust or reset progress, items or Dead Coin, for example to fix a bug or an exploit. We will try to warn players in advance when we can. The Game may sometimes be unavailable.
6. Dead Coin and virtual items
The Game has one in-game currency, Dead Coin, plus virtual items such as cars, weapons, attachments, skins, crates, keys, materials and Hideout buildings ("Virtual Items").
- No cash value. Dead Coin and Virtual Items are not money and have no real-world value. They can't be exchanged for money or anything else of value, by us or by anyone else.
- Licensed, not owned. When you earn Dead Coin or earn or buy Virtual Items, we give you a limited, personal, revocable license to use them in the Game. You don't own them, and they aren't your property.
- No real-money trading. Don't sell, buy or trade Dead Coin, Virtual Items or accounts for real money or anything outside the Game, on any website or app.
- They can change. We may change, rebalance, rename or remove Dead Coin and Virtual Items as the Game evolves. If the Game shuts down, or your account is closed, your license ends and you lose them.
7. Purchases
The Game is free to play. Dead Coin is earned in game and is not sold for real money. We may offer cosmetics and convenience features through supported payment providers. Real-money purchases are currently unavailable. When purchases are available:
- Prices are shown before you buy and may change over time.
- What you buy is a license to Virtual Items as described in section 6.
- All purchases are final and non-refundable, except where the law requires otherwise. This doesn't limit any rights you have under consumer law where you live, including any right to withdraw that can't be waived.
- Purchases made through an app store also follow that store's terms and refund process.
- If a payment is reversed or charged back without a good reason, we may remove what was bought or suspend the account.
8. Crates and odds
Crates and crate keys can't be bought, with money or with Dead Coin, and can't be traded, sold or gifted between players. You find them in raids, and some free rewards (such as daily gifts, missions and trader tasks) include one. What's inside is random. We publish the odds for every crate, and you can see them in the Game by tapping a crate and choosing Odds.
9. The player market
The market lets players list Virtual Items for Dead Coin and buy what others have listed.
- You set your own price. A sale is final once it goes through. We keep a fee (currently 5% of the price) and send the rest to your in-game mailbox.
- Some items can't be listed, including crates and crate keys.
- All trading happens in Dead Coin, inside the Game. Arranging payment of any kind outside the Game is not allowed.
- We may cancel listings or reverse trades that come from a bug, an exploit, fraud or a stolen account, and we may change market rules and fees.
- We don't guarantee that anything will sell, or what it will sell for.
10. Fair play
The game server decides what really happens in every raid, and it checks what clients report. Anything that tries to get around that is banned. Don't:
- use cheats, hacks, trainers, modified game files or clients, or anything that reads or changes the Game's memory or network traffic;
- use bots, scripts, macros or other automation to play or to farm Dead Coin or items for you;
- exploit bugs or glitches. If you find one, report it to us instead;
- create extra accounts to abuse invites, to trade with yourself, or to get around a ban;
- team up with other players or AI to rig results, or deliberately feed loot to another account in exchange for anything outside the Game;
- attack, overload, probe or scrape our servers, or try to reach data or accounts that aren't yours;
- impersonate us, our staff or another player.
We may remove Dead Coin, items or progress gained unfairly, and we may take action on any accounts involved.
To keep raids fair and to fix bugs, the game server records what happens in every raid, including where each car is about once a second, and keeps replays for 30 days. The Privacy Policy explains exactly what is recorded and how long it is kept.
11. Chat, usernames and other things you post
You're responsible for what you post in the Game, including chat messages, your username and anything you write in listings ("Your Content"). It must follow the Community Guidelines.
You keep whatever rights you have in Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, show, moderate and remove Your Content, as needed to run, promote and improve the Game. For example, we may show your username on leaderboards and in raid results that other players share. This license ends when Your Content is deleted, except for copies we need to keep for safety, legal or record-keeping reasons.
Other players can see your username, chat messages and listings. We may review, hide or remove anything that breaks these Terms or the Guidelines, but we don't have to check everything.
12. Our game and your license to play it
The Game, its code, art, music, characters, names and logos belong to us or our licensors. We give you a limited, personal, non-exclusive, non-transferable, revocable license to play the Game for your own non-commercial entertainment, following these Terms. Don't copy, sell, reverse engineer or make derivative works of the Game, except where the law allows it. Sharing screenshots, clips and raid result cards is welcome.
13. Suspension and termination
If you break these Terms or the Guidelines, we may warn you, hide or limit your chat, remove Virtual Items or Dead Coin, reset progress, suspend your account or close it for good. For serious cases, such as cheating, fraud or threats, we may act without warning.
You can stop playing at any time, and you can delete your account in Settings. See the Privacy Policy for how deletion works. When an account is closed, your license to Dead Coin and Virtual Items ends, and they are not refunded, except where the law requires it.
We may change or stop offering the Game, or any part of it. If we shut the Game down, we will try to give reasonable notice in the Game or on this website.
Sections 3, 6, 11 (the license you give us), 12, 14, 15, 16, 17 and 19 still apply after your account ends.
14. Disclaimers
The Game is provided "as is" and "as available", especially during the beta. As far as the law allows, we make no promises that it will always be available, error-free, secure, or that your progress or Virtual Items will never be lost. We don't give any warranties of merchantability, fitness for a particular purpose or non-infringement. Some places don't allow these exclusions, so some of them may not apply to you.
15. Limitation of liability
As far as the law allows, we and our members, managers, staff, contractors and partners won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, Virtual Items or goodwill, arising from or related to the Game.
As far as the law allows, our total liability for any claim related to the Game is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$50.
Nothing in these Terms limits liability that can't be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
16. Indemnity
As far as the law allows, you agree to defend, indemnify and hold harmless [LEGAL ENTITY NAME], LLC and its members, managers, staff and contractors from any claims, losses, damages and reasonable costs (including reasonable attorneys' fees) that arise from your breach of these Terms, your misuse of the Game or Your Content.
17. Governing law and disputes
Governing law. These Terms and any dispute about the Game are governed by the laws of the State of [STATE] and applicable United States federal law, without regard to conflict-of-law rules.
Talk to us first. Before starting any formal claim, you agree to contact us at support@undeadisland.gg and give us 30 days to try to resolve it informally. Most problems can be sorted out quickly that way.
Where disputes are heard. Any claim that isn't resolved informally will be brought only in the state or federal courts located in [COUNTY, STATE], and you and we consent to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in small-claims court if it qualifies.
Individual claims only. As far as the law allows, claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative action.
Time limit. As far as the law allows, any claim must be brought within one year after it arose.
If you are a consumer, you keep any protections that the law of your home country or state gives you and that can't be changed by agreement, including any right to bring a claim in your local courts.
18. Changes to these terms
We may update these Terms as the Game changes. We will post the new version here and change the date at the top. If a change is significant, we will also tell players in the Game before it takes effect. If you keep playing after a change takes effect, you accept the updated Terms.
19. General
- Entire agreement. These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about the Game.
- Severability. If any part of these Terms can't be enforced, the rest stays in effect, and that part is enforced as far as the law allows.
- No waiver. If we don't enforce a part of these Terms right away, we can still enforce it later.
- Assignment. You can't transfer your rights under these Terms. We may transfer ours, for example if the Game or the company is sold or reorganized.
- Things outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages of hosting providers, networks or app stores.
- Notices. We may send notices in the Game, by in-game mail or on this website.
